The Court of Appeal, Abuja Division on Friday set aside a Federal High Court, Abuja judgment proclaiming Oladipupo Adebutu the Peoples Democratic Party (PDP) governorship candidate in Ogun State, Oladipupo Adebutu, for the 2023 gubernatorial election. Oladipupo is the son of Lottery mogul, Chief Kessington Adebutu, popularly called ‘Baba Ijebu’.
A three-member panel of the Appeal Court, in a ruling on Friday, faulted the judgment of Justice Taiwo Taiwo (now retired) in which he declined jurisdiction to entertain a suit filed by Jimi Adebisi Lawal.
Lawal had challenged the PDP’s utilisation of a delegates’ list as against the list of delegates who were elected at the ward congresses for the conduct of the May 25, 2022, governorship primary election.
Justice Biobele Georgewill, in the lead judgement today, ruled that the Federal High Court has jurisdiction over the case as it is pre-election related. The judge also orders remitting the case to the Chief Judge of the Federal High Court for the hearing of the case on merit.
It would be recalled that an Abeokuta Federal High Court, presided by Justice Oluremi Oguntoyinbo, had last week voided Adebutu’s candidacy in another suit filed by another aspirant of the party.
