Chief Judge transfers Ibrahim’s case to Federal High Court, Akure

The Chief Judge of the Federal High Court, Justice John Terhemba Tsoho has transfered to the Akure Division of the court, the suit filed by an  Ondo State Senator, Mr Jimoh Ibrahim challenging the All Progressives Congress(APC) primaries, that produced the incumbent governor, Mr Lucky Aiyedatiwa as the party’s candidate in the upcoming gubernatorial election of the state.

APC had  on May 14, 2024 asked the Chief Judge of the Federal High Court, to transfer the case filed by the defeated aspirant, from Abuja to Ondo State, being the venue of the primary election subject matter of the suit.

Ibrahim, a serving senator instituted the suit at the Abuja Division of the Court on May 3, 2024, seeking to void the primary election that produced Governor Aiyedatiwa as the candidate of the party for the November election.

Sued in the suit as defendants are the APC, Governor Aiyedatiwa and INEC.

However in a letter dated May 22, 2024 and addressed to Matthew Burkaa SAN, the Chief Judge notified the parties of the transfer of the case.

The letter signed by Mr Joshua Ibrahim Aji, the Special Assistance to the Chief Judge reads: “I am directed by His Lordship, the Honourable Chief Judge to inform you that action has been taken by transferring this case to the Federal High Court, Akure, after considering the reply from Chief Chris Uche SAN of counsel for the plaintiff, to the first defendant’s application”.

The case which is slated for mention before Hon Justice Inyang Ekwo in Abuja on May 29, will now move to the Federal High Court Akure, which in line with extant practice direction issued by the Hon Chief Judge to the effect that all pre-election matters should be heard and determined in the judicial division where the election took place

The Governorship election comes up on November 16, 2024.
