Ibadan, Oct. 15, 2024 (TheGavel) – The National Industrial Court in Ibadan has ruled in favor of Mr. Ilesanmi Temokun, awarding him a N10 million compensation against Nestle Nigeria PLC for negligence resulting in serious injury sustained while on duty.
Mr. Temokun, represented by his counsel Mr. Tope Temokun, filed a negligence suit against Nestle Nigeria PLC and Mary Bolajoko Consultancy Services Limited following an incident on Sept. 4, 2021. The claimant suffered a life-threatening injury when an iron locker fell on him at Nestle’s premises.
During the proceedings, Mr. Abraham Adeoye, counsel to Nestle, argued for the dismissal of the suit on grounds of merit, but the court found in favor of the claimant.
In delivering the judgment, Justice John Peters emphasized the employer’s responsibility to ensure workplace safety. He noted that proper fixing of the iron locker could have prevented the accident. The injury sustained by Mr. Temokun resulted in spinal shock, requiring medical advice against strenuous activities and prolonged standing due to his age.
“The first defendant, Nestle Nigeria PLC, owes a duty of care to the claimant,” Justice Peters stated. “The claimant has adequately proven his case.”
As a result, Mr. Temokun was awarded N10 million as compensation for the injury, along with N500,000 as litigation costs. The judgment also includes a 20% per annum interest on the compensation until fully settled.(NAN)
