Abuja, Sept. 18, 2024 (TheGavel) – An Upper Area Court in Kubwa, Abuja, has dissolved a 16-year marriage between Hajarat Isa and her husband, Muhammed Hassan, due to a lack of love.
Judge Mohammed Wakili granted the divorce in accordance with Islamic Law, following Isa’s request on this basis. Wakili ordered the issuance of a divorce certificate to Isa and noted that she would not need to observe “Iddah,” as the couple had not consummated the marriage since 2022. Iddah is a waiting period of three months that must be observed before entering another marriage.
Isa, a mother of four, testified that she married Hassan under Islamic law in 2008 but expressed her disinterest in the union, asking the court to grant her divorce.
Hassan, however, claimed he divorced Isa and remarried her in 2022 while he was away in his hometown. He stated, “I will grant her a divorce but want her to return all my belongings in her possession. She sold my television, a PlayStation I bought for the children, and my clothes and shoes. We have not consummated the marriage since 2022, and I provided her with a shop and capital to start a business before I traveled. When I returned, she sold my gym equipment.”
Isa countered, explaining that during Hassan’s absence, she was the sole caretaker of their four children, as well as two children from his previous marriage. “I sold the said items to take care of our children. I am a private teacher and was only paid N15,000 when he left. I later fell very sick, and my younger brother had to help with the children while my older sister took care of me,” she said.
She further clarified that she did not sell the gym equipment but reported it as stolen, asserting that the sales of other items were necessary for the family’s upkeep. Hassan acknowledged that he believed the items might have been sold for necessary expenses while he was away, and he forgave her for it. (NAN)
