Ondo guber race: Court strikes out Omogoroye’s case against Aiyedatiwa

The Federal High Court, Abuja, presided over by Emeka Nwite, has struck out the case filed by Engr Judith Folakemi Omogoroye, against Ondo State candidature of  Governor Lucky Aiyedatiwa, as All Progressives Congress(APC) candidate for the November 16, 2024 gubernatorial elections.

When the case was called today May 29, 2024, Matthew Onoja, appeared for the plaintiff.

Tayo Oyetibo, SAN with Hakeem Afolabi, SAN, Matthew Burka, SAN appeared for APC; Chief Wole Olanipekun, SAN with Bode Olanipekun, SAN, Ebun-Olu Adegboruwa, SAN appeared for Governor Lucky Aiyedatiwa while Chief Charles Edosomwan, SAN appeared for the Independent National Electoral Commission (INEC).

Mr Onoja informed the court that the case was ordinarily adjourned for hearing of Plaintiff’s motion today. The Plaintiff has however instructed him to discontinue the suit against all the defendants. A Notice of Discontinuance dated 29th May 2024 has been filed and all parties have been served.

Oyetibo confirmed service of the notice of discontinuance. He said APC is happy that the suit is being withdrawn as was done with the other sister suit. He said both cases should not have been filed at all.

Chief Wole Olanipekun, SAN informed the court that he has been served with the notice of discontinuance and he has no objection as a defendant cannot force a plaintiff to continue. And even though he has filed all his papers in defence of the suit, he will not ask for cost in the interest of a harmonious relationship between the parties.

Charles Edosomwan, SAN stated that he has been served with the notice of discontinuance and he has no objection. He urged the plaintiff to join the winning team and help the Governor to win the general election for their party as one house.

After listening to the arguments, the Court consequently struck out the suit based on the notice of discontinuance dated 29th May 2024.

Onoja on behalf of the Plaintiff thanked the court and the defendants for not asking for costs.

The case was filed by Engr Omogoroye on 15th April 2024, seeking to disqualify Governor Aiyedatiwa for allegedly presenting a forged certificate to INEC during his election as Deputy Governor of Ondo State in 2020.
